Arbitration is a confidential way to resolve your family law issues. It also allows you to have more control over the process than the Court system by allowing flexibility in the process and more timely results. The parameters of the arbitration can be set by agreement. Arbitration is appropriate for willing parties who are seeking a quick result and hoping to avoid going to court.
We offer different types of arbitration such as full hearing arbitration or med-arb, where the arbitrator will try to mediate issues (that is, obtain the parties’ agreement on the issues) before an arbitration hearing. If any of the issues cannot be mediated, then the arbitrator proceeds to arbitrate (that is, make a decision on issues not resolved by agreement) after a hearing.
There are, as well, other forms of arbitration that can be explored with interested parties.
The benefits of arbitration are many, and include flexibility of process, interim applications that may be heard by telephone conference rather than in court, and time limits for the arbitrator’s decision.
